Agriculture income is exempt under the Indian Income Tax Act. This means that income earned from agricultural operations is not taxed. The reason for exemption of agriculture income from Central Taxation is that the Constitution gives exclusive power to make laws with respect to taxes on agricultural income to the State Legislature. However while computing tax on non-agricultural income agricultural income is also taken into consideration.
What does the term Agricultural Income mean?
As per Income Tax Act income earned from any of the under given three sources meant Agricultural Income;
(i) Any rent received from land which is used for agricultural purpose.
(ii) Any income derived from such land by agricultural operations including processing of agricultural produce, raised or received as rent in kind so as to render it fit for the market, or sale of such produce.
(iii) Income attributable to a farm house subject to the condition that building is situated on or in the immediate vicinity of the land and is used as a dwelling house, store house etc.
Now income earned from carrying nursery operations is also considered as agricultural income and hence exempt from income tax.
In order to consider an income as agricultural income certain points have to be kept in mind:
(i) There must me a land.
(ii) The land is being used for agricultural operations.
(iii) Agricultural operation means that efforts have been induced for the crop to sprout out of the land .
(iv) If any rent is being received from the land then in order to assess that rental income as agricultural income there must be agricultural activities on the land.
(v) In order to assess income of farm house as agricultural income the farm house building must be situated on the land itself only and is used as a store house/dwelling house.
Certain income which is treated as Agriculture Income;
(a) Income from sale of replanted trees.
(b) Rent received for agricultural land.
(c) Income from growing flowers and creepers.
(d) Share of profit of a partner from a firm engaged in agricultural operations.
(e) Interest on capital received by a partner from a firm engaged in agricultural operations.
(f) Income derived from sale of seeds.
Certain income which is not treated as Agricultural Income;
(a) Income from poultery farming.
(b) Income from bee hiving.
(c) Income from sale of spontaneously grown trees.
(d) Income from dairy farming.
(e) Purchase of standing crop.
(f) Dividend paid by a company out of its agriculture income.
(g) Income of salt produced by flooding the land with sea water.
(h) Royalty income from mines.
(i) Income from butter and cheese making.
(j) Receipts from TV serial shooting in farm house is not agriculture income.
Certain points to be remembered;
(a) Agricultural income is considered for rate purpose while computing tax of Individual/HUF/AOP/BOI/Artificial Judicial Person.
(b) Losses from agricultural operations could be carried forward and set off with agricultural income of next eight assessment years.
(c) Agriculture income is computed same as business income.

Any processing done on Agricultural produce to make it marketable is a part of agricultural operations and such amount recoved will be treated as agricultural income only. Say for example trashing of wheat, mustard, etc is part of agricultural operations only and the amount recoved will be treated as agricultural income only no matter processing takes place on on the land itself or some other place.
But in certain cases like in the case of tea, coffee, sugarcane where a major processing is being done then some part of the processed produce (tea, coffee & sugar) is taxed as non-agricultural income and rest is exempt as agricultural income.

No Matter whether the land is urban or rural agricultural land. If agricultural operations are carried out on land the income derived from sale of such agricultural produce shall be treated as agricultural income and will be exempt from tax.

Agricultural income is exempt from income tax. no matter agricultural operations are done by an industrial organisation or an individual. If any industrial organisation grow crops and sale half of the goods as raw material in market and remaining further processed and sold as finish goods the income earned on first half of produce which is sold in market as raw material is totally exempt from tax.
The second half of the produce which is further processed in this case scheme of presumptive taxation is applicable. Rule 7,7A,7B & 8 of Income tax rules deals with such type of income. Rule 7A deals with Income from manufacture of rubber, 7B deals with Income from manufacture of coffee and Rule 8 deals with Income from manufacture of tea. . Rule 7 deals generally wich says that in cases in which income is partially agriculture and partially from business the market value of the agricultural produce which has been raised by the assessee or received by him as rent in kind and which has been utilised as a raw material shall be deducted from the sale receipts and will be treated as agriculture income. Remaining will be treated as non agricultural income.

In your case income is earned in two parts . Ist is sale of fodder to animal farm and 2nd sale of milk to society. Profit earned on sale of fodder to animal farm will be agricultural income and will be exempt while profit earned on sale of milk to society is taxable income. Market price of fodder will be deemed to be the sale consideration received by u on captive consumption of fodder.

As per the Income Tax Act Agriculture Income means income derived from land which is used for agricultural purpose. In your case no land is being used for agriculture purpose in hydroponic system. There fore prima facie income derived from hydroponic system is not an agriculture income. But as per the latest ammendment in Income Tax Act in 2008 “…any income derived from saplings or seedlings grown in a nursery shall be deemed to be agriculturral income”. So if you tell the IT Dept. that what u r doing is similar to nursery operations, then I think it will be helpful to u and ur operations wil be considered as agricultural operations.

1) Will the sales of agricultural produce on a rented/leased farm (i.e not owned by me) be deemed as an agricultural income? If so, what documentations would be deemed necessary?
2) Can “sale of seeds” be interpreted as trading of seeds or is just restricted to seeds produced as a result of the agricultural activity.
3) If I lend a harvester/tractor to other farmers and charge them for it then does such income be qualified as an agricultural income?

If coconuts are grown by you then the market value of coconuts will be treated as agriculture income and income earned on sale of copra less market value of coconuts will be treated as non agriculture income.

Onus to prove that certain income is agriculture income lies on the assessee himself. Hence if you want to claim benefit of expenses then you have to arrange receipts of expenses incurred.

Income from Coffee farm will be calculated in the same manner as Business income is calculated. While calculating income from coffee farm, interest paid to bank on borrowed funds for purchase of farm is deductible as business expenditure. So Cheer Up . There is nothing to worry.

We are getting the seed production done through organizer. For which we are making payments to the organizer for the raw material i.e raw seed purchased by him on our behalf. We are making payments to him for the graded seed and for the services offered by him i.e like certification expenses, grading and packing , storage etc. done by the party on our behalf. The payments so done for graded seed and for the services offered by him comes in preview of TDS under section 194 or the same is exempt under agriculture income.

After reading all the quarries and suggestions about the tax exemption for certain income generated through agriculture .i am interested to ask few some of my quires
[1] I am working in private firm, would like to invest some part of my money to start nursery by leasing a land of agriculture to produce plants and tree saplings which I am planning to used for my landscape purpose in future and also to sell the plants sampling if required.
Is the money given for lease/rent and spent on the nursery activities [if all details of expenses kept in the written form/ bills] can be considered as tax exemption to my salary income.
[2] And the second one, I am planning to start the landscape firm in which agriculture activities like planting of trees species and shrubs and their maintenance in some of residences and companies will be carried. Does the income generated through these Landscape activities is taxable, and doest this activity has service tax applicable.

Land use of a particular piece of land is governed by the local authority and the state government in which particular land is situated.
Hen u can know about procedure & conversion charges from the local development authority office.
As regarding taxes on agriculture land it is also governed by respective state govt. Hence u can know about it from patwari of that particular area.

I am a retired person whose only source of income is FDs in public sector banks. I am paying on an average 20% tax on my total income. I live in a rural area and have very meager expenses. The main income source for the people in my area is agriculture or diary. I was wondering if it makes sense for someone like me to invest in agricultural land where I provide agricultural related services to the local community.
Can I deducting the expenses I am incurring (and losses) from my taxable income. Is this considered an acceptable way of reducing my tax burden while creating assets.

You have not disclosed which type of agricultural related services u are thinking to provide to local community. If u uses that land as warehouse to keep agriculture store or u use that agriculture land for farming then only it will be treated as agricultural activities and income thereon will be exempt. But in that case also losses from agriculture will not be setoff from normal income.

A govt. organisation purchases levy rice from miller. The total payment for such supply of rice includes milling charges, the milling charge so paid, say @Rs.20 per quintal. It is worth mentioning that there is no agreement between the organisation and the miller for such supply. The supply is made by the miller only on the instruction of the State Government.
Now the question is whether this milling charge is subject to TDS i.e. applicable under section 194.

We purchased 10 Acres of agricultural land near Sriperambudur, Chennai in 2006 and these lands do not come under the ambit of 2(14) of IT Act. Although we did some paddy, ground nut & red chilly cultivation, we did not show them in the revenue records till 2009. Only 2009-10, we have shown them in the revenue records and agricultural income is also declared in our returns for the FY 09-10. For this year also, we are showing some agricultural income. We now propose to develop these lands with a builder and would like to know if these lands quality for claiming exemption from LTCG tax ?

Capital gain is not attracted in case of sale of agricultural land no coming within the ambit of sec 2(14) of IT act. But if that land is sold as stock in trade profit arising will be taxable as business income. In cases of conversion of capital asset into stock in trade taxability arises under two heads. Capital gain will be computed on the date of conversion of capital asset into stock in trade (which is nil in your case) and after conversion business income will be calculated.

In any transaction TDS is to be deducted at the time of payment (or credit of account whcichever is earlier). In your case you had already borne cost of development and now you are selling the land. So at this moment TDS cannot be deducted.

As income from agriculture is tax free people would tend to convert their black money to white easily by showing agricultural income. Is there any limit on agricultural income ? As now there is paperless return u just have to declare your agricultural income in the return form. Meanwhile you have to collect with yourself all proof to substantiate your agricultural income which is to be produced during the assessment proceedings before the AO. Thre is no limit of showing agricultural income.

ITR is to be filed if your gross total income exceeds Rs. 160000/-. In your case it seems that if you had earned Rs. 50 lakh from agriculture then you must have invested that money in some type of asset which is geneeating some non-agriculture income. Decision can only be taken after getting full facts of the case.

Your employer company is deducting tax on your salary income but for final tax computation your agricultural income will be clubbed with your non-agricultural income (for rate purposes only) and ten only tax liability will be determined. This you can do by yourself or furnish the details to your employer for correct tax deduction.

I am planning to take on lease agricultural land and cultivate this land and generate agricultural income. As this is for a large piece of land, I am also proposing to raise funds from some close friends and family to finance the working capital for this agricultural activity.

Agricultural income from leased land is also exempt from tax. If you incur any agricultural loss then under the provisions of income tax act you can carry forward your agricultural loss to next 8 assessment years. But agricultural losses can be set off against agricultural profits only. Interest income / share of profits would be taxable in the hands of investors. All the above answers will stand even if you carry agricultural activities in a Pvt. Ltd. Co.

Share of the sale proceed of public company is taxable as business income. No agriculture activity is being carried out by public co. . It is only purchasing flowers from the farmer(pvt. co.). This case is similar to business of a florist.

Since agricultural land is not a capital asset as defined under the Income Tax Act no capital gain/loss is computed on sale of Agricultural land. The profit/loss computed on sale of agricultural land is a capital receipt not chargeable to tax.
Profit on sale of agricultural land is no where defined as Agricultural Income under the Income Tax Act .
While calculating book profit under MAT exempt income credited to P/L A/c is reduced and expenses relating to exempt incomes are added back to the Profit as per P/L A/c . It is also not given that capital profit should be reduced from profit as per P/L a/c . Hence profit on sale of agriculture land is to be taken in book profit while calculating MAT.
However one can form a different opinion on this.
If this agricultural land is shown as stock in trade then it will certainly be taxable.

Income Earned by your father in FY 2010-11 cannot be transferred in your account in FY 2011-12. More over if you get transferred land in name of your wife then also income earned from that land will remain taxable in your father’s hand under the clubbing provisions of the Act.

You can gift trees to ur sister. I don’t think it is chargeable to tax if she sell it after a span of time. If she immediately sells them after gift then it will be taxable income.

The onus to prove that your income is exempt lies on assessee. It is difficult to prove an agricultural income without any proof/receipts. So it is better to show agricultural income with proper proofs otherwise it will be treated as non agricultural income.

If I enter into an agreement with land owner of agriculture land, where I take the land from them on lease / rent basis , pay them rent and do the agricultural operations by myself. If your land is a rural agricultural land then profit on sale of agri land is capital receipt not chargeable to tax. If it is land located in urban area then you have to pay capital gain tax.

Agricultural income is exempt from tax . However it is clubbed with non agricultural income for rate purpose. In your case agricultural income of Rs. 30000/- will be added with Rs. 500000/- to calculate tax and then deducted later on. You have to show your agricultural income in your income tax return.

Since raisins are obtained only after processing of grapes , hence sale of raisins is non agricultural activity and its income is taxable. u can search the case law on internet.

sir, i have large mango gardens where i have grown different variety of mangoes which are of great demand where people come to my gardens and purchase in bulk raw mangoes which they will ripen at their residences. i have roughly about 40 to 50 lacs of sale every year which i record by maintaining receipt book day register and cash book. the next day sale amount is deposited in my bank a/c after deducting the expenses. i do not have a pan card. is it mandatory to file the returns of the income as i do not have any other income. is it mandatory to get a pan card?

I you have only and only agricultural income or your non agricultural income is less than the basic exemption slab then u need not file your return of income. However filing return of income have certain other benefits also.But i will suggest u to atlest obtain a PAN card.
